What it will come down to is whether it was your responsibility or her responsibility under the law not a bunch of he said she said crap that carries no weight in court.
Is that legal? I mean, you know it wasn't stolen, you already said you forgot to take it off the car. Are you getting yourself into more trouble by doing that? Be careful is all I'm saying. You don't want to add more injury to all the insult and injury.

It sounds like with your thought processees you could easily land your ass in jail with upwards of a few thousand in legal fees.
If you apply for a replacement title what are you going to tell the IRS for taking a write off on a car you still own. They might get you even with her driving the damn thing so not only will you have the state of virginia after you but also the irs who could decide not only to prosecute you but audit you for the last 20 years of tax returns and stick it to you for not having documentation going far enough back.
if you technically still own the car and you wrote it off on your taxes you could potentially be in trouble anyway. Damn, scaring people is fun. Maybe I should of gone to law school. ;D
Seriously, the only thing that works in situations like this is admitting fault or accepting fault with as little trouble as possible and explaining the truth not trying to take steps to punish people or whatever that may or may not be outside the law. Making waves when it comes to the law in court is not a good approach as the Grim Jesus can attest. Lawyers are expensive, court costst are expensive, and judges and lawyers and the irs don't like the squeaky wheel pain in the ass.
You should probably attempt to say that you thought the tags were stolen though if you actually reported them stolen and then say something like oh I found out they just weren't transferred and the women who has my car is driving with them. Maybe they'll just think you're a dolt.
....but you probably would want to retract the stolen plate accussation if they aren't stolen under the law as soon as possible while claiming ignorance rather than talking yourself into a bigger mess.

His only crime was being too nice. He probably gave his car to one of those people that were buying Louis Vatan(SP?) purses with their FEMA card........
I have some familiarity with the law and court by the way not only through my own experiences but both my brothers have been lawyers for about 15 yrs. One does criminal defense the other business and malpractice.
