Sen Al Franken passed a bill recently that prevents employers from putting an "anti-rape" clause in their contracts. A woman (Jamie Leigh Jones), was working for KBR; a subsidiary of Halliburton, when she was gang-raped while working in Iraq by co-workers. She was then stuffed in a crate when she tried to complain about the assault. Back in America, she tried to sue KBR but couldn't because of a fine print in her contract that prevents her from taking legal actions against employees. The bill, fortunately did pass with a vote of 68 vs 30. All 30 nays were made by republicans who wished to "keep government arbitration out of private contracts". What do you guys think? Did partisanship go to far? Or is it a legitimate claim that "big government is bad for business"?

Have you heard anything different? If I recall correctly the vote was indeed 68 to 30. It is also true that those 30 were republicans. I don't know about you but it's hard to find a justifiable reason to vote against that bill. It clearly states that "it will remove the right to include provisions to which effect an employer can include a clause in a contract that prevents an employee to take legal recourse against an employer when victim of sexual assault in the workplace". I don't know if the entire story about stuffing Jamie Leigh Jones in a crate is true, but that's the whole point of the thread; to hear some opinions on it. I didn't realize I had to flatter someone else's point of view to engage in a discussion. By the way, I think that bill was a no-brainer, what harm can it cause? I only see safer workplaces and better rights for women. Why did they vote against it?

How about this chick not reading and understanding the contract? Is it the governments fault that she didnt read and understand the contract? Is it the governments fault that the 'incident' happened? No. It is her fault for not reading and understanding what she signed. It is KBRs fault for not handling the situation properly. That clause is in the contract so when you go over to Asscrackistan, or Iraq, and get killed your family cant sue KBR for your 'untimely' death. well in my opinion the bill serves to protect people from companies that use complicated lingo in their contracts. try this: suscribe to any e-mail provider like hotmail or g-mail and try to read through their entire user's agreement and policies... you'll see how easy it is to slip in a clause. the companies do that to slash their costs with liability insurance.
it's not about the government protecting people... times change and the government has to go along with it... you know back in the 30s it was not uncommon to see children exploited in plants or mines by companies, the government had to step in to protect the children... it is not uncommon for a government to regulate the business practices of companies... it happens all over the world and it is needed... if you leave it in the hands of CEOs and fatcats to regulate themselves nothing is gonna get done... the bill causes no harm to anyone... it just makes sure that sexual assault is punished... it has nothing to do with sky diving, cigarettes, guns, whatever... it was made specifically for sexual abuse... don't you think it's a bit unfair if your sister or girlfriend/wife gets raped in the parking lot where she works and she can't take the guy to court? all because she doesn't have the major in law needed to be able to understand the complex contract lingo... think about it... it's not about suing the company... it's about suing the individual...
