we bought a house. we put the other one up for sale. we had someone ask if they could lease it month-to-month with 30 days to leave when it sells, and they will keep yard up/house accessible to potential buyers. tenant wants to buy house. tenant has great credit and $ but on his credit report is lien from IRS and he owes for back childsupport. tenant wants us to rent-to-own for 33 years. not an option. we need to sell the house and pay back for the downpayment on the new house. real estate agent is in a networking group w me. he is not charging anything for managing the property. i find out last week that tenant is refusing to leave the property when house is being shown, on average of 4-5x/week. there have been 3 serious buyers who want tenant out of house when they come to see house but tenant won't leave. tenant tells agent 'this is my house, i'm paying for it and i am not leaving all of my things in there.' i also find out that another realtor's customer called realtor to ask who was owner of company so she could report him for being rude. unfortunately, realtor is owner. agent tells me to write a letter to evict him. my daddy says agent needs to write letter on his letterhead and spell out terms of lease and give option to make property available or evict. daddy also says that i need to use the term 'fudiciary responsibility'. then fucking tenant calls at 10 last night to say he got power bill, which is still in my husband's name, and it's $600. so i get to call him in a little bit and play all nicey-nice and tell him that he was supposed to go down to AL power and have the power put into his name. this is the biggest fucking headache. i swear, with that storm last night i was hoping that when he called he was going to say house got hit by lightning and it was on fire.
It's your house and if you are going through a real estate agent to sell it, who ever is living in it is not supposed to be there. I can understand not wanting people all up in my shit, but he has to realize that it's not his house. I rented a house a couple of years ago and gave the landlord a month notice that I was moving. He asked me if it would be alright to show the house and I said, "No problem." (It didn't bother me because I already bought the house I was moving to and was eager move in anyway, so my stuff was gone by the time he showed it). Fuck rent to own. You want to get rid of the house and the guy is preventing you from doing so. I say evict him. I don't know what the laws are in your state about that stuff, but I don't think you really need much of a reason to evict. You just have to give them like 30 days. Or I guess you could give him the option to cooperate or be evicted.
Evict. If his credit is A+ then he can get a mortgage, fuck the IRS if he can get a mortgage tell him to buy it or get the fuck out.
Evict. There is a definite conflict of interest where this guy is cock-blocking other potential buyers from seeing the house. He is stacking the deck in his favor and should either comply with the initial terms of the arrangement or hit the pavement. If it gets ugly, it's his fault. Let the realtor be the heavy if need be.
i'm right there with you guys. the question now is whether to file a complaint against the agent as well. he and i are in a business group together, and for him to allow this to go on is not the best business practice. i will be filing a complaint against him in the group, but the question has arisen in regards to filing with board of realtors. guess we'll see how this plays out. did i tell you that another realtor wanted to complain to the owner of his company because he (agent) was rude to her client? unfortunately, he's the owner. that's the thing that gets me most. i am not going to let this fuckhead have the privilege of living in that house and 1/2 acre of land that a CHILD would love to run in. why should i help him? i mean, really i'd rather help his ex wife and the child he left behind. or, i don't know, say MY CHILDREN. dick.
Sorry I'm so late with a reply. I spent the weekend away. ImP, if you have potential buyers wanting to look at the house, get the bum out of there, clean it all up nice, put an air ionizer in the living room so that the house stays fresh, and sell the thing. Having a hostile tenent in the house is the worst road block to selling that there is. The amount that they pay in rent may help in the short term., but it costs money in the long run. Get the house clean, neat, and empty, and it will sell easily. Spend a day caulking all the trim, and painting over your kids artwork, and it looks neat and fresh. Carpet is cheap too. Throw away anything outside that doesn't have to be there. Make sure that all the hinges work on the cabinets. If you don't replace the carpet, then at least have it restreched. Two kinds of houses sell easily - Those that are clean, well decorated and with perfect yards, and those that are clean andempty with lots of potential for cosmetic improvements.
yeah.. we've already done all of that. we paid for a very nice full 1700sq foot paint job. it's cosmetically perfect and ready to go. the yards are immaculate. eviction letter is on the way.

Expect him to trash the place before he leaves. Those kind of people are just like that. If he does, sue him in small claims court. It will cost you little to file, and it will haunt him for years. You probably won't get anything, but at least the monkey will be on his back. Or just handle it the old Mobile way. Have his legs broken, and throw him off the AfricaTown Bridge. It's not murder. The guy has ever right to swim to safety.

hey dwaine - you're the smart one around here. he has IRS liens against him and doesnt file a tax return, owes so much for that and back child support that he could never pay it off. would letting the irs know where he is do any good? and how would i go about doing that? barry is paying off his sins - he doesn't bill me.
Im not sure about your location, but in Augusta we have an IRS office, so if you have one I'd go by there. Maybe ask them how he can have so many leins, why dont they arrest him? DAMN THE FLAT TAX!

He would get an audit, if he is in the rears for child support, he will goto jail, (in nc) first time is 3 days mandatory, 2nd 90 days, third 6 months, then it's an hibital offense and caries 6 years, 2nd offense after that is until the child turns 18, with a lien on any income he ever makes
but he doesn't file taxes, works for cash and has no bank account. i know, i know - my realtor picked a real winner.
